Renting physical space is only step one. Before opening your doors to the public, your commercial premises must meet municipal zoning laws and statutory county licensing requirements.
Operating without valid licenses exposes your business to court summonses, heavy fines, or physical closure by County Executive Enforcement Officers ("Kanjo").
Mandatory Commercial Premises Licenses
1. Single Business Permit (SBP)
Issued by the local County Government (e.g., Nairobi City County, Mombasa County, Kiambu County), the SBP allows your business to trade legally within that jurisdiction.
- Cost Factor: Scaled based on business size, headcount, premises square footage, and sector risk.
- Renewal Period: Issued annually and must be renewed by March 31st of each year to avoid late payment penalties (typically 3% monthly compounding).
2. Fire Safety Inspection Certificate
- Required for all commercial spaces to verify compliance with OSHA (Occupational Safety and Health Act).
- Inspects functional fire extinguishers, clear emergency escape routes, smoke detectors, and visible assembly point signage.
3. Public Health License & Food Handlers Certificates
- Mandatory for: Restaurants, bakeries, food processors, cafes, and salon/spa establishments.
- Requires a county health officer to conduct a physical hygiene audit of the premises.
- Food Handlers Certificates: All staff handling consumables must undergo medical examinations at a government hospital every 6 months.
4. Outdoor Advertising & Branding License
- If you mount a branded sign board, light box, or wall wrap outside your rented commercial space, county governments levy a separate Signage / Advertising Tax based on square meters of display. Mounting unapproved signage leads to immediate confiscation.
